  2. I would definitely wait another week or two also, except that I have important family medical appointments to keep in both weeks. And, winter is short as we are seeing. Thanks for the feedback PLC and Blackstar. That handle and photo still don't look right.

  3. There are lots of trail reports from the area on the 705 Snowmobiles Facebook group. Yesterday, most saying trails are flat and in good shape with small thin sections. Not a lot of base and a ton of riders going through there this weekend with warm temps. It doesn't sound very promising but if you want to ride next week I don't see where you have many options. I just got off the phone with my buddy because we said we'd make a plan for next week to go somewhere. We decided to stay home and wait another week. Hoping things turn around and the 14 day forecasts are wrong.

  4. Jackpine SC in Iroquois Falls has had at least one and possibly both their groomer broken down all of last week I believe. Timmins and Cochrane have groomed some of Jackpines trails at least once. Haven't seen any updates on F/B for a couple of days on Timmins and Cochrane F/B. No posts on the Jackpine F/B site since Jan.12th.

  5. Problem is, the lawyers cost huge money to defend, so often a settlement is offered. Nobody should be allowed to sue a club. It is an off road activity with sleds now breaking 200hp. Of course you can die or be severely injured. Risk should be placed 100% where it belongs, on us, the riders. Don't like risk, get under the bed, wrap yourself up in bubble wrap and hide until god calls you home when you finally die of boredom.

Short story is that if the stump was on the groomed/travelled portion of the trail the groomer wouldn't miss it and in fact it may have been the drag from the groomer that took the bark off the stump on the last grooming. In Ontario each club was supposed to have someonne whose responsibility it is to look for dangerous spots on the trail and direct having it repaired and also go out to accident scenes and take information and pictures for use by the OFSC in defending themselves. I believe the position was called Orr's (sp). I cannot say for sure if that is still a requirement of the OFSC or not. If the Quebec clubs had a similar club job the lawsuit results may have been different.

  11. I believe that I had read a few years ago that Quebec has the right answer. For lawsuits up to a maximum $ amount (can't remember the amount) If you sued and lost, you had to pay the other parties costs. Too bad Ontario wouldn't adapt this system.

  12. Fubar! Anyone who attempts such a thing is a scum bag for dragging liability into the club. Hopefully the OFSC has enough legal front end to absolve themselves from any such stupidity. If you cant drive and control your vehicle? Its not the road or trails providers fault. Weasels who try and leverage liability like that are the kind of scum who are ruining the Canadian way of life.

  13. In that situation, she will always be at fault. You can not turn into opposing traffic until the lane is clear. The colour of the light has no bearing.

  14. Yes it would, and any reasonable decent human would see that, but as long as the 1% rule is on the books, counsel will look to anywhere and everywhere to find it.

  15. Either way when it ends up in court and the video is shown it would be a travesty of justice to rule against the truck driver in this situation.

  16. I think all or almost all feel it’s the sledder being irresponsible and at fault, but the question lies on how if something did happen, how our glorious judicial system would handle it n this wonky day and age….

  17. Interesting to see the differing view points here. If i was on a bench in that one? Sled guilty of careless driving. Trucker zero charges. Sled at fault 100% in my eyes.

  18. The sleds were traveling the roadway. Then turned left. They weren't crossing from ditch to ditch. If it were a car turning left instead of a sled and the truck hit the car the truck would be at fault. Albeit the snowmobile didn't signal his intentions which does move fault to the sled some. What if it were a bike instead of a sled?

  19. Really? Road traffic has right of way. If that was a car, even if they signaled to come out from the shoulder, they have to enter the roadway safely, with enough distance to get in to the traffic lane, and up to speed safely with the flow of traffic, without impeding it, or causing any issues. Being a snowmobile in this situation, it is even more on the snowmobile. The road traffic always has the right of way. Ski

  22. You should see how the a%%hats in long nose petes drive on 17. It aint the truck, its the driver. Justins imports are now doing over dimensional loads...let me tell you, its scary. They run the load onto oncoming, and illegally run after dark.
