And the OFSCspends a ton of money defending clubs/district/federation against these frivolous claims. From my understanding very few suits are successful but you still have your defence costs. From what I have been told the courts in Ontario are very hesitant to award costs to the defence. Couple that with the whole contingency fees from the personal injury lawyers there does not seem to be any impediments to the plaintiff to file a suit.. the rules should changed so that if a plaintiff loses, they and their lawyers are accountable for the defence costs too. Would make them think twice before filing the statement of claim.
On the bold, you're absolutely right, and I'm not sure that most people understand that. There is nothing stopping anyone from naming a potential target defendant in a SOC - and then, as you pointed out, resources are required to defend against it. Money well spent - but spent!
I have seen few defendants released from actions until after the Examination for Discovery process has been undertaken, which takes quite a bit of work, time and expense even to get up to and through that point. You can always try, but threatening costs if not does not usually scare too many Plaintiff firms.
As I mentioned, with 1% liability on the books - they're going to look anywhere and everywhere for potential defendants.
On costs, my experience differs a little - most times if we are successful and seeking, they are awarded - sometimes in full - sometimes partial - sometimes up to the max ( small claims ). Collecting on them is another story

Not sure if they can do that now. I believe you enter and use trail system at your own risk today. If it happens on a closed trail you have zero case. I am sure data can be saved.
The way some of these people ride and cut corners and go across ditches is mind boggling. That being said most were behaving when I was out there on Tuesday but it wasn't that busy. Different crowd of riders during week 😎
Yes they can and do all the time.

Just looking at the 14 day forecast. God damn!
Most of District 9 just turned red on the ITG while I was looking.
Rode 300 kms today. Puts me at over 700 in 6 days. More than I rode all last season.😜
I am thinking its almost a better idea to have the sleds down here than in Huntsville- seems this area -or the area just north of KW -etc. - can turn and be able to be rideable so quickly - given my very limited schedule - that might be better

And we were not able to get out for a ride at all yet.
what a waste of money

Either way when it ends up in court and the video is shown it would be a travesty of justice to rule against the truck driver in this situation.
Yes it would, and any reasonable decent human would see that, but as long as the 1% rule is on the books, counsel will look to anywhere and everywhere to find it.

I dunno. I was traveling behind some pedal bikers on a road near me. One guy had a dash cam and claimed I passed to close to them. I slowed right down and was following them traveling two and two. So I waited until it was clear and passed them. They called cops with my license plate. They showed up at my house. I had a polite conversation with officer. I said to show me video if you have it. He said he didn't need too since my storey matched what he saw on video. I asked him if he was going to go back to them and ask them to ride single file like they are suppose too. He said if I had hit them on back side of a hill I be at fault 🤦♂️. Bottom line laws are stupid.
The reality is liability is always different in every single situation.
the fault chart used to establish fault for physical damage is irrelevant should a tort action for injuries be pursued.
police investigate for hta, tort claims move on their own. -

? Sled is at fault 100%. Drivers a total dumbass imo. He's darn lucky as mentioned above that was a real trucker and not some humbolt dolt.
Sled is not guaranteed to be 100% at fault.
Ever hear of the 1% rule?

There are two parts to the who is wrong theory.
1.HTA
2. Liability
They do not share the same lense and/or outcomes.

You can tell it’s a professional driver by the hood of the truck, sledded is lucky.

6'-2" and growing shorter.
I heard about the 850 seat. Might be something to look at. I'll play around with what I have for now and see if I grow more comfortable. Or maybe someone will throw a black/gold SRX on Marketplace at a sacrifice price late season.....lol
I've had studs for 25 years. I don't like track spin. My buddy bought his '23 turbo with a Ripsaw, decided not to stud it. He loves it. But when I followed him, I noticed he gets into the power as he enters the corner and slides the track all the way through. I don't touch throttle until I coming out because I'm used to big grip.
Makes zero sense having all the hp and all you can do is spin the track.
i like the grip and bite too

Meh……..lol
It’s alright. I was hoping I would like it more than I do right now and most likely with more seat time and adjustments, I will.
8 years on my Cat so I have to compare. 1 ride and I miss my studs. Ice Ripper needs to go. Steering is heavy which I figured it would be. I find the seating is too far forward, banging my knees on the console, Cat felt more spacious. Cat front end is better in the corners. The ride is better on the Skidoo, especially the rear. The hand and thumb warmers are great and the multiple settings is handy. Can’t even compare the gauges, Doo by far but I have a lot to learn.
From the seat of the pants, the Cat pulls way harder. Prefer the Cat exhaust tone. The Doo drones at low speeds.
Interestingly, I was told I would never use the comfort setting for the Smart shocks as it’s too soft. I was preparing to send my shock module in to Precision EFI for their programming. Well, I couldn’t stand sport mode. It bothered my hands and shoulders cause the bars shook so bad. I switched to comfort and thought it was great, could be a tad softer yet for me but a huge improvement over Sport and never bottomed once.
And I miss my heated seat…….lol
Pretty honest report.
Those Cats are pretty good sleds

Plenty of deep white at our place now - should be a good Sunday for me and the boy.

Of topic, but drivers and their judgement or lack of confidence behind the wheel is insanely poor.
Othewise, awesome pictures of the winter that has shown up!!!
Quick hi-jack.
My daughter has her G2 - we did all the driver training etc. - and I spent a lot of time with her myself.
Anyway - her road test for her G2 - was 7 1/2 minutes long - that was it - in 7 1/2 minutes they issued her a G2 and sent her out into the wild.

Had a look at the map - surprised to see how little has opened up in the far north - getting there - but man - it's mid January already and so much red.
Come one yellow and green!

Saw on our club's FB page they are out doing what they can now that we have some snow.
As usual - need cold - but we live in a time where you get what you get and make the most of it.
Hoping to see some yellow in the next week if things co-operate.
Might be field running/shake down time this Sunday as we have no hockey!

Lots of event cancellations going on up in the Grey Bruce region - so that is a positive sign if you're a sledder
