Saw this posted and thought I would share:

 

Help us identify two good samaritans. 
Do you know who stopped to help an injured rider of a red Polaris snowmobile on OFSC trail #D123 between Burks Falls and Katrine Ontario? Sun Jan 23 4-5pm. If so please call #AlmaguinHighlandsOPP at 705-382-2015

A) I would like to think that ANYone that comes upon a down rider will stop to help.

We're not all Jewish priests or Levites.

 

B] They are looking for witnesses, not congratulations.

yeah, no way, stay out of it and stay anonymous.

2 years from now you'll be getting served with a Statement of Claim.

The Good Samaritan law protects the average people who administer first aid in emergency situations from being sued.

Nice try.

There is nothing preventing someone from naming you in a Statement of Claim.

You can choose to defend and try using that as your first line, but you're getting served.

The police would not be searching for these guys for a statement of claim. My guess is somethinig other than "good samaritan" is going on.

It is, and after 22 years of handling Casualty Liability claims, I'm very very jaded - but with real world perspective.

Nothing preventing anything from happening in this crazy world anymore.  

 

Sure You can be named in a lawsuit but we have the Good Samaritan act to protect those people who try to help.  As long as they do not act with negligence.

 

Is it better to try and help or stand back and video?

Really very simple. Think about what you would want people to do if you were injured and do that if ever needed.

Standing by to video would likely meet the gross negligence standard and eliminate the defence under the Good Samaritan bill.

Gross negligence is the standard under the bill, not regular negligence.

but to the point, you will need to defend your actions on that turning point.

Either way, the obvious thing to do is try to help - but don't be surprised anymore when you do - it comes back to cause you an awful lot of turmoil and grief, enjoy going through examinations with an aggressive Plaintiff lawyer

 

I see an awful lot of ridiculous stuff on a daily basis

True, you can be served doesnt mean you are or will be paying into someones lawsuit. 

As long as you act in good faith, the GSA protects you from lawsuits and has already been tried here in a court of law.

100% agree. They are now pushing this story to every news media and social site now. There is something up for sure ..
